These Terms and Conditions govern the use of our services and the operation of our mobile golf simulator trailer provided by Mobile Fairwaze. By booking our services or accessing our mobile golf simulator, you agree to abide by these Terms.

1. Booking and Payment

Reservations: All bookings are subject to availability and must be confirmed by Mobile Fairwaze over the phone or via our booking platform.
Payment: A deposit of $100 is required to secure your reservation. Full payment must be received at the time of your reservation.
Cancellations & Refunds: Cancellations made at least 48 hours in advance will receive a full refund. Cancellations made within 24 hours may result in a partial refund or forfeiture of the deposit. No-shows are non-refundable.
Weather Policy: Events may be rescheduled at no charge due to extreme weather or unsafe conditions, at our discretion.

2. Use of Simulator and Trailer

Age Restrictions: Users under the age of 16 must be supervised by an adult at all times.
Behavior: All participants are expected to behave respectfully and follow safety instructions. We reserve the right to remove any individual engaging in unsafe, disrespectful, or destructive behavior without refund.
Capacity Limits: The number of people allowed inside the trailer at one time may be limited for safety reasons.
Damage: Customers are responsible for any damage to equipment or the trailer caused by negligence or misuse.

3. Assumption of Risk and Liability Waiver

Participation in the golf simulator involves inherent risks, including, but not limited to, personal injury, equipment malfunction, or property damage.
By participating, you acknowledge and assume all such risks and release Mobile Fairwaze, its employees, and affiliates from any liability arising from injury, loss, or damage incurred during your use of the simulator or trailer.
A waiver may be required to be signed by all participants (or guardians of minors) before use.

4. Safety and Accessibility

Our trailer is equipped with standard safety features; however, accessibility may be limited based on the location and terrain.
The trailer must be parked on a flat, stable surface with adequate clearance, approximately 30 ft x 20 ft for safe setup and operation.
We reserve the right to cancel or modify the event if conditions are deemed unsafe upon arrival.

5. Intellectual Property

All branding, designs, graphics, and simulator software used during your event are the property of Mobile Fairwaze and may not be copied, altered, or reused without permission.

6. Privacy Policy

Our use of customer data is governed by our Privacy Policy. We only collect and use personal information to process bookings, communicate with customers, and improve our services. We do not sell or share your information with third parties except as necessary to operate our business.

7. Force Majeure

We are not responsible for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, severe weather, accidents, power outages, or government restrictions.

8. Governing Law

These Terms shall be governed by and interpreted by the laws of the state of Ohio. Any disputes shall be resolved in the courts located in Summit County, unless otherwise required by law.
